Notice of Appeal on Local Government Commission Auckland reorganisation decision

30 November 2017:

Auckland Reorganisation Decision

The Local Government Commission has determined its preferred option for local government in the Auckland Council affected area is the existing local government arrangements in Auckland – the status quo. The final determination can be found here:

The options for North Rodney and Waiheke Unitary Authorities are not considered to meet the statutory tests for reasonably practicable options set out in the Local Government Act 2002 because:

  • they would not have a region that is appropriate for the efficient performance of their role; and
  • they would not have the resources necessary to carry out effectively their responsibilities, duties and powers.

Having considered the relevant matters, the Commission is satisfied that the existing local government arrangements is the preferred option as it will, in the affected area of Auckland, best promote the purpose of local government and will facilitate improved economic performance.

Auckland Options Assessment - August 2017

9 August 2017 – The Local Government Commission has released a report authored by Morrison Low to assist the Commission identify the “reasonably practicable options’’ for local government in Auckland as part of the current reorganisation process.

The report’s findings are just one input into the Commission’s decision-making process. The Commission will also consider communities of interest analysis and the results and findings of any other investigations or inquiries it considers appropriate in its determination of the reasonably practicable options and, subsequently, the preferred option for local government change in Auckland.

The reasonably practicable options must always include the status quo local government arrangements for the affected area (Auckland).

Talking to Auckland communities (6 September 2016)

The Local Government Commission is running a phased engagement programme to hear from the public about local government services in Auckland as a result of receiving two applications for local government change – one from the Northern Action Group (North Rodney), the other from Our Waiheke (Waiheke Island).

In August 2015, the Commission agreed to assess an application from the Northern Action Group (NAG) for a unitary authority for North Rodney. The Commission had earlier declined to assess the application on public interest grounds but was overturned on this ground by the High Court.

The Commission has since been gathering further information.

On 14 April, the Commission to determined that the “affected area’’ for the application is the Auckland Council area, and not just North Rodney. It also decided there is demonstrable community support in the Auckland Council area for local government reorganisation and notified its intention to call for alternative applications.
